PUBLIC NOTICE IS HEREBY GIVEN THAT:

Bids must be submitted electronically, up to the hour of 4:00 P.M. Thursday, February 1, 2024, through the City of Fillmore’s PlanetBids bidding portal at: https://pbsystem.planetbids.com/portal/53681/portal-home. A hard copy of the entire bid package, including all original notarized documents, must be received by the Office of the City Clerk, Fillmore City Hall, located at 250 Central Avenue, Fillmore, California, 93015, on February 1, 2024, the bid submittal due date, to be considered responsive to this Notice Inviting Bids for Project Specification No. 23-05.

The words “TWO RIVERS PARK DOG PARK IMPROVEMENTS, PROJECT SPEC NO. 23-05” shall appear on the envelope of each sealed bid, and each sealed envelope shall be addressed to the City Clerk, City Hall, 250 Central Avenue, Fillmore, California 93015. 

DESCRIPTION OF WORK:  The work to be done consists of furnishing all materials, equipment, tools, labor, and incidentals as required in the Plans, Specifications and Contract documents for said project to remove and dispose existing turf grass; remove and dispose existing drip irrigation system material, amend existing site soil, furnish and install new turf grass, furnish and install new conventional low volume over-head sprinkler system, complete in place including all appurtenant work.  As indicated on the construction documents, the work will take place only within the designated area of the Two Rivers Park, in the City of Fillmore, California, and other related work as described in the Specifications and Contract Documents, by reference, made a part hereof. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. 

THE ENGINEER’S ESTIMATE FOR THIS PROJECT IS: $118,220. 

COMPLETION OF WORK:  All work to be done under this contract shall be completed within FORTY-FIVE (45) consecutive working days, beginning on the date stipulated in the written "Notice to Proceed" to be issued by the Engineer. 

 LIQUIDATED DAMAGES:  Liquidated damages of $500/day will apply to this project.  See Special Provisions for detailed information on liquidated damages.

 STATE LABOR STANDARDS & WAGE REQUIREMENTS:  In entering into a public works contract, or a subcontract, to supply goods, services, or materials pursuant to a public works contract, the Contractor and all subcontractors agree to follow the State Labor standards.  State Labor standards provisions, including prevailing wage requirements, will be enforced such that the general rate of per diem wages (prevailing wage) shall be paid for each craft, classification, or type of worker needed to execute the contract to all workers employed in the execution of the contract. All contractors and subcontractors must furnish electronic certified payroll records directly to the Labor Commissioner (aka Division of Labor Standards Enforcement) as further described in Article IX of the Agreement. The State General Prevailing Wage Determination is as established by the California Department of Industrial Relations (available at https://www.dir.ca.gov/Public-Works/Contractor-Registration.html). The prevailing rate of per diem wages are on file at the City of Fillmore, Department of Public Works, 250 Central Avenue, Fillmore, California 93015, and are available to any interested party on request. 

AWARD OF CONTRACT:  Each contractor and subcontractor listed on the bid must be registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5, subject to the limited exceptions set forth in Labor Code Section 1771.1(a) (regarding the submission of a bid as authorized by Business & Professions Code Section 7029.1 or Public Contract Code Section 10164 or 20103.5, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded).      

 BID GUARANTY:  Bids must be accompanied by cash, or by cashier's or certified check made payable to the City of Fillmore, or by a bid bond executed by an admitted surety insurer on the bond form provided herein, in the amount of ten percent (10%) of the amount of bid price, made payable to the City of Fillmore as a guarantee that the bidder, whose bid is accepted, will promptly execute the contract, secure payment of workers’ compensation insurance, and furnish a satisfactory faithful performance bond in the amount of one hundred percent (100%) of the total bid price and a payment bond (labor and material bond) in the amount of one hundred percent (100%) of the total bid price which complies with all of the requirements of Civil Code Section 9554.

RETENTION:  The City will deduct a five percent (5%) retention from all progress payments as specified in Section 9-3.2 of the Standard Specifications for Public Works Construction.  The City in accordance with Public Contract Code Sect. 22300 shall permit the substitution of securities for any moneys withheld by a public agency to ensure performance under a contract.  The City hereby incorporates herein all of the provisions set forth in Public Contract Code Sect. 22300. 

CONTRACTOR'S LICENSE:  At the time of “Award of the Contract”, the Prime Contractor must have a valid California State Contractor's License with a classification of “A” (General Engineering) or “C-27” (Landscaping) in accordance with provisions of Chapter 9, Division 111, Sections 7000 through 7145 of the Business and Professions Code of the State of California and the Prime Contractor shall warrant that it and all subcontractors are properly licensed, which includes each entity having a local business license.

CITY'S RIGHTS RESERVED:  The City reserves the right to reject any and all bids or to waive any irregularities or informalities in any bids or in the bidding, should it deem this necessary for the public good, and also the bid of the bidder who has been delinquent or unfaithful in any former contract with the City of Fillmore.  No bidder may withdraw his or her bid for a period of sixty (60) days after the date from the opening thereof.

BID QUESTIONS:  All bid questions shall be submitted through the PlanetBid portal for the benefit of all proposed bidders.  The questions shall be submitted by 10:00 A.M. Thursday on January 25, 2024.  One response to all questions will be posted in PlanetBid on following day. 

BID RESULTS:  Bid results shall be available electronically on PlanetBids after the bid submittal deadline.
